We also use the legitimate interests’ legal basis to send out promotional material to previous good customers of the company, for a period of 18 months after the most recent loan you have taken with the company, as we consider this to be both in your interest and ours.


How Long We Keep Your Data

Western Circle Ltd only ever retains personal information for as long as is necessary and we have strict review and retention policies in place to meet these obligations. We keep your basic personal data (name, address and contact details) for a minimum of 6 years after which time it will be destroyed.

Your employment contact details and payment details are retained by us for two years after the date of your loan application or the repayment of your most recent loan, whichever is the later.

Where you have consented to us using your details for direct marketing, we will keep such data until you notify us otherwise and/or withdraw your consent.


Special Categories Data

Owing to the nature of the service that we offer, Western Circle Ltd sometimes needs to process sensitive personal information (known as special category data) about you, to ensure that our customer service department deals with you in a fair and sympathetic manner. We also may receive sensitive personal information when legal action is taken to recover an outstanding balance. TRANSACTIONS CONCLUDED THROUGH OUR SITE

Contracts for the supply of financial services formed through our Site or as a result of visits made by you are governed by our terms and conditions.

You agree to provide us with all relevant proof of identification that we reasonably request, including proof of identity and proof of nominated bank current account and associated debit card.


CHARGES
We charge fees as follows:-

Card authorisation fee: we charge a card authorisation fee of £0.50 at the time of approval.

Account verification fee: £0.01 (one pence) may be deducted from your nominated bank account on the day preceding the date of repayment of the loan. We process a nominal transaction to enable us to confirm that your bank account remains active.

Same-day transfer fee: we charge a supplementary fee of £5 should you expressly ask us to transfer the funds advanced by us to you by way of same-day bank transfer.

Default charges: (i) In the event that your repayment is made after 5.00 pm on the due date: £15.00; and (ii) daily interest of 1% on all arrears, capped at a maximum of 60 days. These charges, if applied, will be added to the total sum to be repaid under your loan agreement.


DEBT MANAGEMENT PROGRAMMES, INDIVIDUAL VOLUNTARY ARRANGEMENTS & BANKRUPTCY

In the event that you are in a DMP, IVA or are currently bankrupt you may not apply to us for any financial services or products that we offer on our Site.

In the event that you enter into a DMP or IVA, or are made bankrupt, after you enter into an agreement with us, you must notify us immediately.


VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.
